Terms of Service

1. Service Description
Digital Cards Club ("the Service") is a cloud-based platform that enables organisations to create, manage, and distribute digital wallet passes (Apple Wallet and Google Wallet) for memberships, loyalty cards, events, and other use cases. The Service is provided by Digital Cards Club Ltd, registered in England and Wales.
2. Account Terms
- You must be at least 18 years old to create an account.
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- One organisation per account. Each organisation may have multiple authorised users.
- You must promptly notify us of any unauthorised access to your account.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws
- Upload or distribute content that infringes third-party intellectual property rights
- Attempt to gain unauthorised access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to send unsolicited communications (spam)
- Store or process data in violation of data protection laws
- Resell or redistribute the Service without written permission
- Use automated systems to scrape or extract data from the Service
4. Data Processing Responsibilities
When you use the Service to process personal data of your members:
- You are the Data Controller: You determine the purposes and means of processing your members' personal data. You are responsible for having a lawful basis for processing and for informing your members about how their data is used.
- We are the Data Processor: We process personal data on your behalf in accordance with your instructions and this agreement. We implement appropriate technical and organisational measures to protect the data.
- You must ensure you have obtained appropriate consent or have another lawful basis before uploading member data to the platform.
- You are responsible for responding to data subject access requests from your members, using the GDPR tools provided in the platform.
5. Payment Terms
- Free Plan: Available at no cost with feature limitations as described on the pricing page.
- Paid Plans: Billed monthly or annually in GBP via Stripe. Prices are exclusive of VAT where applicable.
- Billing Cycle: Subscriptions are billed in advance. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
- Failed Payments: If payment fails, we will attempt to charge your payment method again. After repeated failures, your account may be restricted to the free plan.
- Cancellation: You may cancel your subscription at any time. Access to paid features continues until the end of the current billing period.
6. Refund Policy
We offer a 14-day money-back guarantee for new paid subscriptions. If you are not satisfied with the Service within 14 days of your first paid subscription, contact us for a full refund. After 14 days, refunds are not provided for partial billing periods, but you may cancel to prevent future charges.
7. Intellectual Property
- Our IP: The Service, including its design, code, features, and documentation, is owned by Digital Cards Club Ltd and protected by intellectual property laws.
- Your Content: You retain ownership of all content and data you upload to the Service, including member data, branding assets, and card template designs.
- Licence to Us: You grant us a limited licence to host, process, and display your content solely for the purpose of providing the Service.
- Feedback: Any feedback or suggestions you provide may be used by us without obligation or compensation.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control, including third-party service outages, network issues, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim arising from the Service shall not exceed the amount paid by you in the 12 months preceding the claim.
- Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
10. Termination
- By You: You may close your account at any time through the Settings area or by contacting support. Upon closure, your data will be retained for 30 days before permanent deletion.
- By Us: We may suspend or terminate your account if you violate these terms, fail to pay, or if required by law. We will provide reasonable notice except in cases of serious violations.
- Effect of Termination: Upon termination, your right to use the Service ceases. You may export your data before account closure using the GDPR data export tools.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to Terms
We may update these terms from time to time. We will notify registered users of material changes at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
